Lux Mundi Learning Terms and Conditions for Online Spanish Courses

Welcome to Lux Mundi Learning’s Online Spanish 1 and 2 Courses. By enrolling in our courses, you (the “Participant,” meaning the student or, if the student is a minor, their parent or legal guardian) agree to the following Terms and Conditions. Please read this agreement carefully, as it governs your participation in our courses, outlines your rights and responsibilities, and includes important information about privacy, recordings, and compliance with the Family Educational Rights and Privacy Act (FERPA) and the Children’s Online Privacy Protection Act (COPPA).
1. Course Description
Lux Mundi Learning offers online Spanish 1 and 2 courses delivered through a secure, password-protected Canvas learning management system. The courses utilize proprietary methodologies licensed from the University of Florida to enhance learning outcomes. The courses include:
Coursework: Assignments, quizzes, and instructional materials accessible via Canvas.
Conversation Practice: Live, interactive Zoom sessions with trained native Spanish speakers facilitated through Lingua Meeting, a third-party organization. These sessions are recorded for educational purposes.
VoiceThread Activities: Students will create and submit video recordings of themselves speaking Spanish via VoiceThread, a secure platform. These recordings will be viewed by the course instructor and other enrolled students within the same course for educational purposes.
2. Term and Termination This agreement is effective from the date the student is first granted access to the Canvas course (the “Course Start Date”) and continues until the course end date, unless terminated earlier. Either party may terminate this agreement with 7 days’ written notice to the other party at support@luxmundilearning.com. Termination will not affect the rights and duties of enrolled students for the current course term. Lux Mundi Learning reserves the right to terminate participation for students who violate the Code of Conduct (Section 9).
3. FERPA and COPPA Compliance and Student Privacy
Lux Mundi Learning is committed to protecting student privacy in accordance with FERPA, a U.S. federal law that safeguards the privacy of student education records, and COPPA, which governs the collection, use, and disclosure of personal information from children under 13. Our COPPA Privacy Policy, available at www.luxmundilearning.com/coppa-privacy-policy, provides detailed information on how we collect, use, and protect personal information from students under 13. The following measures ensure compliance:
Education Records: Recordings or materials containing personally identifiable information (PII), such as a student’s name, image, voice, or coursework, are considered education records under FERPA. These records will only be shared with:
The course instructor and other students enrolled in the same course section for instructional purposes.
Parents or legal guardians of minor students, upon request, per FERPA guidelines.
Authorized school officials or third-party contractors (e.g., Lingua Meeting, VoiceThread, Zoom, Canvas) with a legitimate educational interest, under Lux Mundi Learning’s direct control regarding PII use and maintenance.
Parental Rights (FERPA): Parents or legal guardians of students under 18 have the right to:
Inspect and review their child’s education records, including Zoom and VoiceThread recordings.
Request amendments to records believed to be inaccurate or misleading.
Provide written consent before PII is disclosed to third parties, except as permitted under FERPA exceptions (e.g., school officials, directory information).
COPPA Compliance: For students under 13, Lux Mundi Learning will obtain verifiable parental consent (via the attached FERPA and COPPA Consent Form) before collecting, using, or disclosing personal information (e.g., name, voice, image) through Zoom, VoiceThread, or other platforms. Parents may revoke consent at any time by contacting support@luxmundilearning.com. See our COPPA Privacy Policy at www.luxmundilearning.com/coppa-privacy-policy for details.
Data Security: All course materials, including Zoom recordings and VoiceThread submissions, are stored securely with administrative, physical, and technological safeguards. Third-party platforms (Canvas, Zoom, VoiceThread, Lingua Meeting) are vetted to ensure compliance with FERPA and COPPA.
4. Eligibility and Registration
Eligibility:
Spanish 1: Students must be at least 11 years old and capable of engaging in a flexible-paced Spanish course, as determined by Lux Mundi Learning.
Spanish 2: Students must have completed Spanish 1 with a grade of C or better or demonstrate equivalent experience (e.g., prior coursework or placement assessment, subject to Lux Mundi Learning’s approval).
Lux Mundi Learning reserves the right to modify eligibility criteria with written notice to participants via support@luxmundilearning.com.
Registration Procedures: To enroll, participants must submit a completed registration form, signed Terms and Conditions, signed FERPA and COPPA Consent Form, and full payment to support@luxmundilearning.com within one week of receiving enrollment confirmation. Students will receive confirmation of enrollment and access to Canvas upon approval. Contact support@luxmundilearning.com or (267) 391-5254 for registration assistance.
5. Consent for Recordings and Use of Third-Party Platforms
5.1 Zoom Conversation Sessions with Lingua Meeting
Purpose: Students will participate in live Zoom sessions with trained native Spanish speakers through Lingua Meeting to practice conversational skills. These sessions are recorded for educational purposes, such as instructor review, student reference, or quality assurance.
Access: Recordings are stored securely and accessible only to the course instructor, enrolled students in the same course section, and parents/legal guardians of minor students upon request. Parents may attend live Zoom sessions if desired.
Native Speaker Background: Lingua Meeting’s native speakers are trained and quality-controlled but are not subject to U.S.-based background checks, as they operate outside the U.S. academic system and provide post-secondary-level instruction. Lux Mundi Learning has vetted Lingua Meeting to ensure their practices align with our educational standards and privacy policies.
Consent: By signing the attached FERPA and COPPA Consent Form, you consent to the recording of Zoom sessions that may include the student’s name, voice, or image. These recordings will only be used for educational purposes within the course and will not be shared with third parties outside of FERPA/COPPA-permitted exceptions. If you do not consent, notify Lux Mundi Learning in writing at support@luxmundilearning.com before the course begins, and alternative arrangements (e.g., de-identification, camera-off participation) will be made.
5.2 VoiceThread Video Recordings
Purpose: Students will create video recordings of themselves speaking Spanish via VoiceThread as part of course assignments. These recordings will be viewed by the course instructor and other students in the same course section for educational purposes, such as peer feedback or grading.
Access: VoiceThread recordings are stored securely within the Canvas platform and are only accessible to authorized course participants. Recordings will not be shared outside the course without written consent, except as permitted by FERPA/COPPA.
Consent and Waiver: By signing the attached FERPA and COPPA Consent Form, you consent to the creation, storage, and sharing of VoiceThread recordings containing the student’s PII (e.g., name, voice, image) with the course instructor and other enrolled students. You waive any claim to additional rights or compensation related to these recordings, provided they are used solely for educational purposes within the course. If you do not consent, notify Lux Mundi Learning in writing at support@luxmundilearning.com before the course begins, and alternative assignment options will be provided.
5.3 Opting Out: Students cannot be compelled to consent to recordings. If you opt out, Lux Mundi Learning will take reasonable steps to de-identify the student (e.g., blurring images, omitting names, allowing camera-off participation) or provide alternative assignments. Opting out may impact participation grades if alternatives cannot fully replicate the assignment’s objectives.
6. Parental Involvement
Access to Sessions: Parents or legal guardians of minor students may attend live Zoom sessions with Lingua Meeting or request access to recordings by contacting support@luxmundilearning.com. Access will be provided in accordance with FERPA and COPPA.
Parental Consent: For students under 18 (FERPA) or under 13 (COPPA), a parent or legal guardian must sign the attached FERPA and COPPA Consent Form to confirm consent for course participation, recordings, and use of third-party platforms (Lingua Meeting, VoiceThread, Zoom, Canvas).
7. Course Enrollment and Refund Policy
Enrollment: Enrollment is confirmed upon payment of the course fee and submission of this signed agreement and the FERPA and COPPA Consent Form. Fees are non-refundable except as outlined below.
Refund Policy:
Cancellations Before Course Start: Cancellations made before the Course Start Date (the date the student is first granted access to the Canvas course) are eligible for a 100% refund.
Cancellations Before Week 3: Cancellations made before the end of the third week after the Course Start Date are eligible for a 50% refund.
After Week 3: No refunds will be issued after the third week following the Course Start Date, except in cases of documented medical or family emergencies, subject to Lux Mundi Learning’s discretion.
Withdrawal Procedures: Students must officially withdraw from the course by notifying Lux Mundi Learning in writing at support@luxmundilearning.com by the end of the third week after the Course Start Date. Failure to withdraw officially may result in incomplete coursework, which could affect course completion or homeschool records. No refunds will be issued for withdrawals after week 3, as per the refund policy.
Cancellation by Lux Mundi Learning: If Lux Mundi Learning cancels a course due to insufficient enrollment or unforeseen circumstances, a full refund will be issued. Lux Mundi Learning is not responsible for non-refundable expenses incurred by Participants (e.g., internet costs, hardware purchases).
Missed Sessions: No refunds or free make-up sessions are provided by Lux Mundi Learning for missed activities or coursework. However, students may schedule make-up sessions through Lingua Meeting for a per-session fee, subject to availability. Recordings of missed Zoom sessions may be available for review, subject to FERPA/COPPA restrictions. Contact support@linguameeting.com for assistance with arranging make-up sessions.
8. Technical Requirements To participate in the online Spanish courses, students must have:
A reliable high-speed internet connection (minimum 5 Mbps download/upload speed recommended).
A computer or tablet with a modern web browser (e.g., Google Chrome, Firefox, Safari) updated to the latest version.
A webcam and microphone for Zoom sessions and VoiceThread recordings.
Access to Canvas, Zoom, and VoiceThread (accounts provided or facilitated by Lux Mundi Learning).
Basic computer literacy to navigate online platforms and submit assignments. Lux Mundi Learning is not responsible for technical issues caused by the Participant’s hardware, software, or internet connection, but technical support resources will be provided.
9. Liability and Disclaimers
Third-Party Platforms: Lux Mundi Learning uses third-party platforms (Canvas, Zoom, VoiceThread, Lingua Meeting) to deliver course content. While we vet these providers for FERPA and COPPA compliance, we are not liable for technical issues, data breaches, or privacy violations caused by these platforms, provided we have taken reasonable precautions.
Native Speakers: Lux Mundi Learning relies on Lingua Meeting’s quality control for native speakers. We are not liable for any conduct or content provided by these speakers, though we will address concerns promptly.
Educational Outcomes: Lux Mundi Learning does not guarantee specific educational outcomes or proficiency levels, as results depend on student effort and engagement.
Limitation of Liability: To the fullest extent permitted by Florida law, including Section 768.28, Florida Statutes, Lux Mundi Learning, its officers, employees, and contractors are not liable for any direct, indirect, incidental, or consequential damages arising from participation in the course, including but not limited to technical issues, loss of data, or dissatisfaction with course content. Lux Mundi Learning maintains general and professional liability insurance to cover its educational services, as required by applicable regulations.
No Waiver of Sovereign Immunity: Nothing herein is intended to waive any rights or limits to liability under Florida law, including Section 768.28, Florida Statutes, if applicable.
10. Intellectual Property and Publicity
All course materials, including lectures, assignments, and recordings created by Lux Mundi Learning, are the intellectual property of Lux Mundi Learning. Participants may not reproduce, distribute, or share these materials without written consent, except for personal, non-commercial use within the course.
Student-created VoiceThread recordings remain the intellectual property of the student but may be used by Lux Mundi Learning for educational purposes within the course, as outlined in Section 5.2.
Publicity: Participants may not use Lux Mundi Learning’s name, logos, trademarks, or images in any publicity, advertising, or media release without prior written consent from Lux Mundi Learning, obtained by contacting support@luxmundilearning.com.
11. Code of Conduct
Participants must engage respectfully in all course activities, including Zoom sessions and VoiceThread interactions. Disruptive, offensive, or inappropriate behavior may result in removal from the course without a refund.
Students may not record, screenshot, or share Zoom sessions or VoiceThread recordings outside the course, as this violates FERPA, COPPA, and Lux Mundi Learning’s policies.
12. Miscellaneous Provisions
Public Records: Lux Mundi Learning complies with Chapter 119, Florida Statutes, regarding public records, if applicable. Each party maintains its own records in accordance with retention requirements.
No Third-Party Beneficiaries: This agreement does not confer rights or obligations on any third party, and no third party may assert claims against Lux Mundi Learning based on this agreement.
Entirety of Agreement: This agreement supersedes all prior agreements, negotiations, or understandings between Lux Mundi Learning and the Participant regarding the online Spanish courses.
Amendments: No modification or amendment to this agreement is effective unless in writing and signed by both parties.
Governing Law and Venue: This agreement is governed by the laws of the State of Florida. Any disputes will be resolved through mediation or arbitration in Gainesville, Florida, before pursuing legal action in a Florida court located in Alachua County, Florida.
Severability: If any provision of this agreement is found invalid or unenforceable under Florida law, the remaining provisions remain in full force.
